Here’s what you need to do: Install the patch For those of you running ArcGIS 10.2 and experiencing crashes when working with shapefiles, it is necessary that you download and install this patch or upgrade to 10.2.1 to apply the fix. Can’t install the patch or upgrade? Shapefiles typically associated with this crash contain dBase files with a large number of fields. Converting these shapefiles to file geodatabase feature classes can help to work around the crashing. Please continue to contact Esri For any and all error reports you receive, please send them to Esri with a valid email address, as this enables us to identify and respond faster to issues impacting your work.

How are you creating a new layer? Are you using the option to "Create Layer From Selected Features", or are you Exporting the data to create a new shapefile?

Yes, I would agree that we need to look at what to do with the Land Records content. We are working on restructuring the Government spaces, and Land records are part of that discussion.

I agree with Dan. A mosiac dataset is much more efficient, especially when it comes to storage and processing speed. Also, I've moved your post into the Managing Data space. You can see the license requirements from the top right of the help page - http://resources.arcgis.com/en/help/main/10.2/index.html#//00170000018r000000 Also, I have moved this discussion to Managing Data‌ from GeoNet Help‌.
