I found the same, after making the mistake of killing it. The Help Library Agent has to be running.
Even then, there are often HTML formatting errors, such as code snippet indentation errors, missing end-of-line characters causing multiple lines of sample code to run together.
And you cannot resize the table of contents window on left side of screen.
I hope it's a 'work in progress', and updated Dev Help will be forthcoming with a future service pack release.
When you find Dev Help topic references to "ArcGIS 9.4", you know it's stale.
In ESRI's defense, they are just following Microsoft's lead in Help format
