Does anyone know where I can get a up to date imagery layer?

In ArcGIS 9.3 Service Pack 1, ArcGIS 9.3.1, and ArcGIS 10 you can use one of the ArcGIS Online Map Services.  These services can be access directly from the Add Data button in ArcGIS 10.  For ArcGIS 9.3 and ArcGIS 9.3.1 you will need to create a connection to the gis service using the following url - http://services.arcgisonline.com/ArcGIS/services/

There is also the Landsat Imagery than can be accessed as a gis service from the following url - http://imagery.arcgisonline.com/arcgis/services
