Identify widget strange behavior

I'm having an issue with one of my layers depending on if it's toggled on or off in the layer list.

Here is the example, when the below configuration is selected, the identify widget works fine:

When the below configuration is used, the identify widget fails to return any values. 

When they are both selected the identify widget works as it should.

  I have found the issue(s) and will have it fixed in version 2.1.1 of the widget. The widget now Truly respects layer visibility based on scale and layer checked state.
