ArcGIS Pro 2.6.8; Oracle 18c 10.7.1 EGDB
When I use the Make Query Layer geoprocessing tool to modify a query layer, the layer gets automatically moved to the bottom of the Contents pane.
(I imagine the layer has been removed and re-added to the map by the GP tool.)

Could that behavior be changed so that the original Contents pane position gets preserved?
Edit: With spatial query layers, the symbology gets reset too. So that tells me that the layer does get removed and replaced. So maybe this idea should be called, "Modify existing query layer using Make Query Layer GP tool instead of removing/replacing it."
