Pop-ups for scale dependent features - Explorer 2012 beta

Explorer 2012 beta still does not display an attribute pop-up window for features in a map service that have a scale dependency set.

Unfortunately, this is the bug that we cannot resolve on the current architecture.

How does Esri get pop-ups to appear from their soils polygons in the Specialty/Soil_Survey_Map (MapServer)?  It appears that the layers in that map service have scale dependencies set and end-users are able to get attribute information in a pop-up window (see attached) in Explorer 1750 and 2012.
