2.2 TOC controls and group layers

I recently upgraded our internal flex project to 2.2 and I noticed an issue with group layer check boxes not having any effect the sub-layers.  What I mean is, the sub-layers will turn on and off, regardless of whether the group box is checked or not.  Now, due to some issues beyond my control, we are still using ArcGIS Server 9.3 and Desktop 9.3.  Do we need to be on version 10 for this to work correctly?  With 2.1, the group layer box would turn all the sub-layers on and off automatically - not exactly ideal, but at least they did something.
