Exclude certain layers from Identify mouse down events?

Hello,

I am wondering if it is possible to exclude certain layers from the identify tool?  I have disabled pop-ups on a polygon overlay layer, but when I use the identify tool on a point layer both the polygon layer and point layer highlight.  Is there a way to limit which layers interact with the identify tool?
