Monty, What exactly do you mean by Are you using a proxy?Are you using security through tokens?Are you using SSL?Are you saying that even when you manually expand the toc items that there is no legend swatches?
Monty, Do you have the ArcGIS Service directory diabled? We are talking about ArcGIS Server 10.1 right? Do you have a sp1 installed?

Monty, You definitely have me confused... The autoswitchtoscale and forcescaleonswitch are associated with the Enhanced Basemap switcher what does this have to do with the TOC Widget? What are you talking about: Are you meaning the "zoom to" or "zoom to make visible" in the TOC popup menu?
