What are the terms of use for embedded ArcGIS online and/Explorer maps within a commercial website?  Are they allowed such that no charge is applied to their use?

Under the agreement for ArcGIS Online, does ESRI assume any ownership for data that is posted?

Do you mean of your uploaded data? Esri doesn't assume ownership of your data...Here's the legalese from this page:

7. SHARING YOUR CONTENT
In the event You desire to share content by uploading or publishing Your Content to a content-sharing function offered through an Esri website, You hereby grant Esri a nonexclusive, nontransferable, royalty-free, worldwide limited license to (i) use, store, cache, copy, reproduce, (re)distribute, and (re)transmit Your Content that is made available to end users of the Esri website; (ii) provide end users of the Esri website with a hypertext reference link from the Esri website to the end user's map services at a specific URL containing Your Content; and (iii) provide Your Content to an end user's web browser as intended by the Esri content-sharing function offered through the Esri website. During the process of registering, uploading, publishing, or submitting Your Content to the Esri website, You must designate and identify any redistribution limitations. You grant to all end users of the Esri website, subject to any redistribution limitations identified by You, the right to access and use Your Content subject to any of Your terms of use, License Agreements, or metadata file information that You provide when Your Content is registered, uploaded, published, or submitted for use on the Esri website.
