Symbols in Legend/Table of contents does not come up

Question

I have a silverlight page- and I have added a mapservice to my map as shown below The legend shows the name of mylayer(I have one layer - mylayer in my published arcmap document) but it does not show the symbols in the layer-theme, like I have a Red-Circle for bad, Green Circle for good, but that legend does not show red-circle or green-circle, it just show the name of mylayer!!! I am using Arcgis Server 10(without service packs) and Arcgis API for Silverlight 2.3 Thanks a lot

Actually i donot have permission to upgrade to SP1

So what should I do thanks a lot

The easiest way would be to migrate to SP1, but....:(
 
Otherwise the previous mean to get the legend was by using the SOAP API. You should be able to get samples on arcgis.com (such as this one or this one)

Yes, you are right.. that is the case... my webservice is not external. So should I put in SP1 ? 
Will there be any licensing issue if I put in SP1?? I am using PRVC license files...
