CheckOut Extension Question

I have some standalone Python script that resides in a ToolBox (ArcGIS 9.3.1) that performs some of the functionality on the Spatial Analyst Extension (Krige).  I perform a checkout of that extension license, do some processing, then check it back in.

What happens to that license if an error occurs that causes the tool to bomb and there is no "gp.checkinextension" performed due to the code failure?

Does the extension return to the pool for availability to other users?  Or is it stuck as perpetual checked-out?

From that URL, it says: "...All checked-out extension licenses and set product licenses are returned to the License Manager when a script completes." --- but really?  Can I be certain a failure in the Python/Tool will return the product to the LM?
