TOC Object doesn't support this action

I'm using this toc http://www.arcgis.com/home/item.html?id=98d9e760d6d1496487ca583b0e8ce73c
for javascript app i'm making. When i was running it under ff or chrome i cannot recall getting errors ever...But when i use IE9 i get errors in the esri api:

TypeError: Object doesn't support this action
TypeError: Object doesn't support this action
exception in animation handler for:onEnd
TypeError: Unable to get value of the property '_adjustToState': object is null or undefined
after running toc.startup();

and the toc itself isnt rendered. Sometimes it works, sometimes it doesn't. Did anyone of you get this kind unreliability with this TOC tool?
