Every one I've tried showed up in the legend. I have also tried this map service in another Flex application. It doesn't show in the legend there either. Could you try copying some of the layers from the broken map service into one of the working dynamic map services and then see if it shows up in the legend? What I did was create a separate mxd for each group, then save each as MSD, created a service for each, then add all services to the Flex Viewer. I discovered that all but one of the msds appear in the legend.
