WMS layer transparency from ArcGisServer

I have published a service to AGS and enabled WMS as an option. When making requests to the WMS a layer with polygons is not displaying as transparent. In the mxd from which the service has been published, the polygon is set to a solid fill with the transparent setting set to 50% in the display tab on layer properties. When viewing the wms request in a web browser the polygon is not transparent and also viewing it in a jsapi it is also not transparent.

Is there a trick to get WMS to obey the transparency settings from the mxd the service is published from ?

Why don't you convert layer transparency to color transparency.

10009: Enabling the option to convert layer transparency to color transparency may improve performance

You can do this while publishing the service (Analysis window).

Still does not display as transparent, tried it with both options when publishing (color and layer).

Any other ideas ?

Are you consuming the WMS layers in ArcMap? Then you could change the display properties of WMS Service Layer in ArcMap.

The layer is ultimately being consumed in an open source wbe maping api in application we have. The wms layer polygons are not displaying as transparent when added to the esri javascript api.
